Artikkelen drøfter hvordan vi bør forstå kravet om likhet for loven i Grl. § 98. Vi spør hvorvidt en appell til likhet for loven har selvstendig normativ funksjon, og eventuelt hvorfor og hva som kreves for at likhetskravets skal realiseres. Artikkelen tar utgangspunkt i et behov for avklaring av disse spørsmålene, da verken forarbeidene til grunnlovsrevisjonen i 2014 eller etterfølgende rettsvitenskapelig litteratur, i særlig grad avklarer hva likhet for loven betyr. Vi utvikler en teori om at likhetsprinsippet i § 98 (...) er et grunnprinsipp for retten som fastlegger begrunnelsesbyrden ved utformingen av lov og annen regulering, og ved rettsanvendelsen. Likhetsprinsippet innebærer at likebehandling krever i seg selv ingen begrunnelse, mens ulikebehandling må kunne begrunnes i henhold til kravene i andre ledd. De to leddene i paragrafen er derfor etter vårt syn uatskillelige: Første ledd stadfester hva som er utgangspunktet, mens andre ledd presiserer hva som ikke regnes som relevante begrunnelser for ulikhet. Likhetskravet er dermed ikke et krav om likt utfall, men et krav om likeverdighet, som vi hevder er en konstitutiv verdi for verdien av politisk rettferdighet. Den forståelsen av likhetskravet i § 98 som vi utvikler, knytter første og andre ledd i § 98 sammen, og åpner for at også første ledd kan bli mer aktivt brukt av domstolene. (shrink)

Few figures of the Middle Ages command the attention of so many modern disciplines as Robert Grosseteste (c. 1170-1253). Theology, Philosophy, History, and Science are all areas which his life and thought continue to have significance and to inspire re-interpretation. Accompanied by a series of original commentaries, this new edition of Grosseteste's work, with English translation, draws together the perspectives of modern scientists and medieval specialists. Volume I of a six volume series, Knowing and Speaking presents two of the earliest (...) of Grosseteste's works, the treatises On the Liberal Arts and On the Generation of Sounds. These are accompanied by a significant Middle English treatise on the Seven Liberal Arts whose anonymous fifteenth-century author translated and excerpted passages from Grosseteste's treatises in a re-imagining of their structure and function.0Each work is treated separately within the volume, which is constructed in three parts. On the Liberal Arts sets Grosseteste's thoughts on the arts subjects and emphasises moral concerns about the purpose of learning. On the Generation of Sounds builds on the theories and statements of On the Liberal Arts in connection to the production of sound, elaborating the earlier position, relating the generation of sounds to human vocal and speech production. If the title of this article resounds with the polemical palavering of literary theory in the 1940s, I have to submit that the allusion is not entirely accidental. It is not my intention here, however, to resuscitate the arguments of W. K. Wimsatt Jr and Monroe C. Beardsley, but rather to evoke a sense of parallelism between their issues and those at stake here. A crucial objective which informed Wimsatt's and Beardsley's project was to buttress the significance and irreducibility of (...) the literary text in the face of monopolistic authorial and receptional meaning-making. [3] The scholarly environment that was American New Criticism tended to consider intentionalism and emotionalism as threats to the epistemological prominence and integrity of the text, which was all too readily lost in a plenitude of contexts whose relevance for the literary work was not always impressively transparent. Similarly, within the domain of film studies, it has perhaps become increasingly unclear whether the real object of study is the film text itself, or rather a concatenation of different disciplinary discourses hailing from departments of psychology, sociology, and biology (to name a few). The colonization of cinema studies is not a novel development; as a process its apogee was in the 1970s. (shrink)

In a 2005 paper Ólafur Páll Jónsson presents a puzzle that turns on intentional identity and definite descriptions. He considers eight solutions and rejects them all, thus leaving the puzzle unsolved. In this paper I put forward a solution. The puzzle is this. Little Lotta wants most of all a bicycle for her birthday, but she gets none. Distracted by the gifts she does receive, she at first does not think about the bike. But when seeing her tricycle, she is (...) reminded of the bike. The question is how we are to analyse these two occurrences of ‘the bike’ in the absence of a unique bike that Lotta wants. So the semantics of ‘the bike’ needs to be spelt out, and it must be made explicit what the complements of Lotta’s attitudes are. My analysis shows that the attributer’s usage of ‘the bike’ blurs the distinction between a second-order and a first-order intension (a property concept and a property, respectively). My solution can be summed up in this two-premise argument. (a) In the state-of-affairs S, the property of being a bike is the extension of the property concept the property such that Lotta wants an instance of it more than any other; (b) in S, Lotta does not think about/is reminded of the property that she wants an instance of more than any other; (c) therefore, in S Lotta does not think about/is reminded of the property of being a bike. This solution requires looking beyond the confines of denotational semantics, which all of Jónsson’s eight solution candidates belong to. (shrink)

In his 2000 book Logical Properties Colin McGinn argues that predicates denote properties rather than sets or individuals. I support the thesis, but show that it is vulnerable to a type-incongruity objection, if properties are (modelled as) functions, unless a device for extensionalizing properties is added. Alternatively, properties may be construed as primitive intensional entities, as in George Bealer. However, I object to Bealer’s construal of predication as a primitive operation inputting two primitive entities and outputting a third primitive entity. (...) Instead I recommend we follow Pavel Tichý in construing both predication and extensionalization as instances of the primitive operation of functional application. (shrink)

This paper is the twin of (Duží and Jespersen, in submission), which provides a logical rule for transparent quantification into hyperprop- ositional contexts de dicto, as in: Mary believes that the Evening Star is a planet; therefore, there is a concept c such that Mary be- lieves that what c conceptualizes is a planet. Here we provide two logical rules for transparent quantification into hyperpropositional contexts de re. (As a by-product, we also offer rules for possible- world propositional contexts.) One (...) rule validates this inference: Mary believes of the Evening Star that it is a planet; therefore, there is an x such that Mary believes of x that it is a planet. The other rule validates this inference: the Evening Star is such that it is believed by Mary to be a planet; therefore, there is an x such that x is believed by Mary to be a planet. Issues unique to the de re variant include partiality and existential presupposition, sub- stitutivity of co-referential (as opposed to co-denoting or synony- mous) terms, anaphora, and active vs. passive voice. The validity of quantifying-in presupposes an extensional logic of hyperinten- sions preserving transparency and compositionality in hyperinten- sional contexts. This requires raising the bar for what qualifies as co-denotation or equivalence in extensional contexts. Our logic is Tichý’s Transparent Intensional Logic. The syntax of TIL is the typed lambda calculus; its highly expressive semantics is based on a procedural redefinition of, inter alia, functional abstraction and application. The two non-standard features we need are a hyper- intension (called Trivialization) that presents other hyperintensions and a four-place substitution function (called Sub) defined over hy- perintensions. This is the first English edition of a major work by the Danish philosopher and theologian K. E. Løgstrup (1905-81). It is the culmination of his critical engagement with Kierkegaardianism, which had begun almost 20 years earlier. In this text, Løgstrup focuses on four main themes in Kierkegaard: his understanding of Christ and thus of Christianity; his understanding of suffering in human existence; Christian vs. secular ethics; and Platonistic influences on Kierkegaard's position, which Løgstrup characterises as nihilistic. Løgstrup presents his (...) own alternative conception in response: that Christ revealed universal ontological ethical structures that put Christians and non-Christians on a par; that suffering is a basic human experience and so there is no such thing as a particular Christian suffering; that sovereign expressions of life such as trust, sincerity, and compassion are the fundamental phenomena of ethics that enable our lives to function, and are thus given as a gift of creation, not of faith; and finally that human existence as created is meaningful and holds value and so is not a Kierkegaardian 'nothingness' of mere relativity. As well as offering a classic and yet controversial critique of Kierkegaard, this text also develops Løgstrup's conception of the sovereign expressions of life, which was to become central to his later ethics, further deepening his distinctive understanding of the human condition. Here translated in full for the first time, it will now be possible for English-speaking readers to explore the issues that drew Løgstrup into his controversion with Kierkegaard. (shrink)

Background Healthcare worker retention and burnout are confounding issues. Trust among workers and their employer, that is, organization, is an important yet underexplored concept in research. Research aim The aim of this qualitative study is to explore organizational actions and systems that promote or denigrate trust among registered nurses and patient care aides (aides). Research design The study uses the Model of Psychological Contract as a theoretical framework. Focus groups were conducted to explore the concept of organizational trust and the (...) consequences of broken trust. Participants Registered nurses (RNs) (n=6) and aides (n=6) participated in the study. Six focus groups (three RN and three aide) were conducted, with two participants per group. Focus groups were conducted online. Ethical considerations The study's methods were reviewed by the University of Pittsburgh Institutional Review Board. Findings Among RNs and aides, a sense of trust and feeling valued were important to their sense of relationship with their employers. Trust was breached when resources were scarce, employees did not feel validated and listened to, and problems were not addressed. RNs and aides described feeling devalued when compensation practices were unjust or inequitable, they had limited autonomy, and the employer created an organizational climate where business needs superceded human caring. Consequences of trust breach included burnout, dejection, and feelings of non-belonging. Discussion Tangible organizational resources (compensation and staffing) and intangible resources (value, respect, autonomy) are important to RNs and aides alike. Inability to provide these resources diminishes trust and even causes a sense of betrayal. Conclusion Future research can explore the concepts of organizational justice and interventions to restore lost trust and improve healthcare worker well-being. This is one of only a few identified studies to explore organizational factors and well-being among aides and more research among this healthcare worker population is warranted. (shrink)

The importance of communities in strengthening the ethics of international collaborative research is increasingly highlighted, but there has been much debate about the meaning of the term ‘community’ and its specific normative contribution. We argue that ‘community’ is a contingent concept that plays an important normative role in research through the existence of morally significant interplay between notions of community and individuality. We draw on experience of community engagement in rural Kenya to illustrate two aspects of this interplay: (i) that (...) taking individual informed consent seriously involves understanding and addressing the influence of communities in which individuals’ lives are embedded; (ii) that individual participation can generate risks and benefits for communities as part of the wider implications of research. We further argue that the contingent nature of a community means that defining boundaries is generally a normative process itself, with ethical implications. Community engagement supports the enactment of normative roles; building mutual understanding and trust between researchers and community members have been important goals in Kilifi, requiring a broad range of approaches. Ethical dilemmas are continuously generated as part of these engagement activities, including the risks of perverse outcomes related to existing social relations in communities and conditions of ‘half knowing’ intrinsic to processes of developing new understandings. 本文旨在初步探索「限肉令」作為應對傳染病大流行和由工廠化畜牧業帶來的其他威脅的預防措施的正當性。「限肉令」並非指全面禁肉，而是以法律限制市民的人均肉品消耗量在滿足基本營養需求的範圍內。本文採用的進路是 緩解一些可能阻礙對此提案進行更宏觀、理性的思考的潛在心理拘繫。此進路參考了傅柯「日常經驗」(everyday experience) 的分析，和佛家倫理學回應全球環境倫理問題的策略。我們先以香港社會為主要案例研究，檢視形成「肉是必需的」一想法和嗜肉情結的社會模式。接著我們引入葷食心理學研究，討論嗜肉情結如何成為正面考慮「限肉令」的障 礙。我們也嘗試回應一些反對此提案的理由，包括來自自由主義 (Liberalism)的批評。 -/- This article explores the preliminary justifiability of meat restriction order as a preventive measure to the risks of pandemic and other forms of harm posed by factory farming. A meat restriction order seeks to limit citizens’ meat consumption at the level of meeting individuals’ basic nutrient needs. This article aims to loosen some potential psychological hooks that prevent a more expansive, rational deliberation of the proposal. Inspired by Michel Foucault’s analysis of “everyday experience” and the (...) Buddhist responses to global environmental issues, we investigate the social patterns that account for the formation of people’s meat commitment, using Hong Kong society as a major case study. With reference to scientific studies of meat-eaters’ psychology, we discuss how the meat commitment becomes a barrier for society to positively consider the justifiability of the proposal. We will also address a number of objections to our proposal, including those from liberalism. (shrink)

The evolution of wireless communications, from the first to the fifth generation, has driven Internet of Things (IoT) advancements. IoT is transforming sectors like agriculture, healthcare, and transportation, but also presents challenges like spectrum bandwidth demand, speed requirements, and security issues. IoT environments, with embedded sensors and actuators, connect to other devices to transmit and receive data over the internet. These data are processed locally or in the cloud, enabling decision-making and automation. Various wireless technologies, including Bluetooth, Zigbee, LoRa, and (...) WiFi, cater to specific IoT applications. 5G, with its high speeds, low latency, and efficient bandwidth sharing, is ideal for high-speed data transmission, and thus it provides robust infrastructure for low-latency and bandwidth-sensitive applications. This latest mobile network technology is being rapidly implemented worldwide, providing unprecedented throughput and low latency, which are crucial for the IoT. This paper presents a comprehensive systematic review on 5G security features, vulnerabilities, threats to mobile devices, security in IoT devices, common attacks to IoT devices and protection of data in this environment. Despite enhanced security, 5G faces challenges like Distributed Denial of Service (DDoS), Man In The Middle (MITM), cross-slice disruptions, and side-channel attacks. (shrink)

Relations between Turkish authorities and their Kurdish minority have been a source of conflict for decades. On 11 April 2015, in the run-up to Turkey’s parliamentary elections, a gunfight broke out in the south-eastern province of Ağrı, resulting in six Kurdish people being killed and four Turkish military personnel wounded. Although skirmishes like this are not unusual, this caught the public imagination as it became clear that Kurdish civilians had helped wounded Turkish soldiers after the shoot-out. The government denied such (...) help and was keen to place the blame for the fight on the Kurdish opposition in its attempt to dissuade the public from voting for Kurdish-oriented parties, thereby increasing their chances of securing a parliamentary majority. The Kurds were keen to do the same to the government for the sake of votes, while the mainstream opposition saw this as an opportunity to represent the government and Kurds as poor voting options. The Turkish media, polarised and closely aligned to political interests, recontextualised events in ways which showed their political ties. This article uses critical discourse analysis to show how this was done in three national newspapers. Furthermore, the article argues that representations as such do nothing to aid in solving the decades-old problem of how Turks and Kurds can coexist peacefully. (shrink)

The approach used by physics is based on the identification and study of ideal objects, which is also the basis of biophysics, in combination with von Neumann heuristic modeling and functional fractionation according to R.Rosen is discussed as a tool for studying the properties of consciousness. The object of the study is a kind of line of analog systems: the human brain, the vertebrate brain, the invertebrate brain and artificial neural networks capable of reflection, which is a key property characteristic (...) of consciousness. Reflection in the broad sense of the word, understood as an internal representation of the external world, is characteristic of a wide range of animals, and some of them (bumblebees, fish) even demonstrate reflection in the narrow sense of the word, understood as an inner self-representation. This complex behavior is realized by miniature brains of ~1 million neurons. The use of simple recurrent neural networks (RNNs) to obtain answers to general questions is illustrated. For example, it has been shown a small RNS is able to pass delayed matching to sample (DMTS) test, forming an individual dynamic representation of the received stimulus, allowing decoding by a special external neural detector.. It has been demonstrated in the reflexive game “even-odd”, the RNS has a huge advantage over a multi-layered neural network, with the same and a larger number of neurons – reflection defeats regression. It was found that the asymmetry of outcomes in the odd-even game, which was explained by various causes, including psychological ones – “it’s easier to catch up than to run away”, is reproduced in the game of two RNNs. Obviously, there are no psychological causes here and the advantage of the player playing for “even” is explained by the more complex strategy of the “odd” player – he needs to predict the opponent’s move and choose the opposite one. Under what circumstances if ever ought we to grant that Artificial Intelligences (AI) are persons? The question of whether AI could have the high degree of moral status that is attributed to human persons has received little attention. What little work there is employs western conceptions of personhood, while non-western approaches are neglected. In this article, I discuss African conceptions of personhood and their implications for the possibility of AI persons. I focus on an African account of personhood that is (...) prima facie inimical to the idea that AI could ever be ‘persons’ in the sense typically attributed to humans. I argue that despite its apparent anthropocentrism, this African account could admit AI as persons. (shrink)
